The Ministry of Industry, Trade and Supply clarified the legal opinion on what has been discussed regarding the administrative void of the position of the General Controller of Companies, which the Council of Ministers decided to refer to retirement as of 1/10/2019. 

According to the legal opinion, which was received from the previous Legislative and Opinion Bureau, the legislator did not prohibit the process of appointment during the period between the date of submission of the resignation and the date of entry into force after acceptance by the competent authority. 

The ministry said in a press statement on Monday that the legislator had authorized the employee to resign before the decision to approve it, and it was not permissible to cancel it after acceptance, which fulfils the requirement of vacancy after accepting the resignation. 

Therefore, the applicant for resignation or retirement shall remain on his job until the decision to accept his resignation becomes effective. Or his retirement at a later date of 1/10/2019.
